These Terms of Service ("Terms") govern your access to and use of the noqueue platform, including the website (www.noqonline.in), mobile applications (noqueue Patient App and noqueue Doctor App), web panel, and all related services (collectively, the "Platform"), operated by SPTSPL ("Company", "we", "us", "our"), with its registered office at P-8, Tilak Marg, C-Scheme, Jaipur, Rajasthan 302005, India.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.

noqueue provides a digital healthcare platform that offers:

• For Patients: Search for doctors and clinics, book appointments online, receive digital tokens, track live queue status, and receive appointment notifications.
• For Doctors: Manage schedules, patient queues, appointments, and clinic operations through dedicated apps and web panel.
• For Clinics: Multi-location management, staff administration, patient records, analytics, and online booking management.

noqueue is a technology platform that facilitates the connection between patients and healthcare providers. We do not provide medical advice, diagnosis, or treatment.

3.1 Registration

To access certain features, you may need to create an account or be registered by a clinic. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use at [email protected].

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any conduct that we deem harmful to the Platform or other users.

• Appointment bookings made through the Platform are subject to availability and confirmation by the respective doctor or clinic.
• noqueue does not guarantee the availability of any particular doctor or time slot.
• Patients are responsible for arriving at the clinic on time. Queue positions and estimated wait times are approximate and may vary.
• Cancellation and rescheduling policies are determined by individual doctors and clinics. Please check with the respective provider.
• Guest bookings (without an account) are facilitated through name and phone number. A basic account may be automatically created for queue tracking purposes.

Doctors and clinics using the Platform agree to:

• Provide accurate and up-to-date information about their qualifications, specialties, schedules, fees, and clinic details.
• Honour appointments booked through the Platform to the best of their ability.
• Comply with all applicable medical regulations, licensing requirements, and professional standards.
• Not use the Platform to distribute misleading information or engage in fraudulent practices.
• Maintain appropriate patient confidentiality in accordance with applicable laws.

• Certain features of the Platform may be available under paid subscription plans. Plan details, pricing, and features are listed on our website and may change from time to time.
• Subscription fees are billed in advance on a monthly or annual basis as per the plan selected.
• All payments are non-refundable unless otherwise stated or required by applicable law.
• We reserve the right to modify pricing with reasonable prior notice to subscribers.
• Free plans or trial periods may be offered at our discretion and may be discontinued at any time.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Submit false, misleading, or fraudulent reviews, ratings, or information.
• Interfere with or disrupt the Platform, servers, or networks connected to the Platform.
• Attempt to gain unauthorised access to any part of the Platform, other accounts, or computer systems.
• Use automated scripts, bots, or scraping tools to access the Platform without our written consent.
• Upload or transmit viruses, malware, or any other harmful code.
• Harass, abuse, or harm other users, doctors, or clinic staff through the Platform.

All content, trademarks, logos, software, and intellectual property on the Platform are owned by or licensed to SPTSPL. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

By submitting content (such as reviews, ratings, or images) to the Platform, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute such content in connection with the Platform.

• Patients may submit reviews and ratings for doctors. Reviews must be honest, based on genuine experiences, and free from abusive or defamatory language.
• We reserve the right to remove or moderate reviews that violate these Terms or our content guidelines.
• Doctors may not incentivise or coerce patients into leaving positive reviews.

• No Medical Advice: The Platform is a technology service and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical concerns.
• As-Is Basis: The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Accuracy: While we strive to ensure the accuracy of information on the Platform (doctor profiles, schedules, fees), we do not guarantee that all information is complete, current, or error-free.
• Availability: We do not guarantee uninterrupted or error-free access to the Platform. We may perform maintenance, updates, or experience downtime without prior notice.

To the maximum extent permitted by applicable law, SPTSPL and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to:

• Loss of data, revenue, or profits.
• Delays, missed appointments, or inaccurate queue information.
• Actions or omissions of healthcare providers found through the Platform.
• Unauthorised access to or alteration of your data.

Our total liability for any claim arising from the use of the Platform shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless SPTSPL and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
